1. Scope

These terms and conditions apply to the use of the paid subscription “PainTrack Pro” (the “Pro subscription”) within the PainTrack iOS app (the “app”). The provider is:

By taking out the Pro subscription you accept these terms.

2. Subject matter of the contract

The Pro subscription extends the free basic version of the app with additional premium features. The exact scope of the Pro subscription is set out in the relevant description in the Apple App Store at the time the contract is concluded.

We develop the app continuously. Its scope of features may therefore change over time. You will be notified in good time of any substantial restriction of existing Pro features.

3. Conclusion of contract

The contract for the Pro subscription is concluded exclusively via the Apple App Store. By confirming the in-app purchase in the App Store you enter into a contract with us. Apple acts as the payment service provider.

The Apple Standard End User License Agreement (EULA) and the Apple App Store terms of use apply in addition.

4. Prices and payment

Current prices for the Pro subscription are shown on the app's product page in the Apple App Store. All prices displayed are final prices including statutory VAT.

Billing is handled through your Apple ID account. Payment is processed by Apple. Apple's payment terms apply.

5. Term and cancellation

The Pro subscription is taken out as an automatically renewing subscription. The term (e.g. monthly or yearly) depends on the subscription option you chose in the App Store.

The subscription renews automatically for the same term unless it is cancelled at least 24 hours before the end of the current term.

Cancellation is done through the subscription management in your Apple ID settings:

  • Open Settings on your iPhone or iPad
  • Tap your name → Subscriptions
  • Select PainTrack Pro and tap Cancel subscription

After cancelling you can continue to use the Pro subscription until the end of the period you have already paid for.

6. Right of withdrawal

As the Pro subscription consists of digital content that is not supplied on a physical medium, Apple's withdrawal rules apply. You can find information on withdrawal and refunds in the Apple support guidelines for subscriptions.

Apple generally offers the option of requesting a refund within 14 days of the purchase date. This is handled directly by Apple.

7. Availability and liability

We endeavour to keep the app and the Pro subscription available at all times. We cannot, however, guarantee uninterrupted availability. Temporary restrictions may arise in particular from maintenance work, updates or faults.

We are liable without limitation for intent and gross negligence. In cases of slight negligence we are liable only for the breach of material contractual obligations (cardinal obligations) and only up to the foreseeable damage typical of this type of contract. Liability for damage resulting from injury to life, body or health remains unaffected.

8. Data protection

Information on the processing of your personal data can be found in our privacy policy. All health data is stored exclusively on your own device and is not transferred to our servers.

9. Changes to these terms

We reserve the right to change these terms with effect for the future, to the extent that this is necessary and does not disadvantage you unreasonably. We will notify you of substantial changes in good time, e.g. by in-app notification or email. If you do not object to the changes within 30 days of being notified, the new terms are deemed accepted. We will point this consequence out to you separately in the notification.

10. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only to the extent that it does not restrict any mandatory statutory provisions of the state in which the consumer has their habitual residence.

Should individual provisions of these terms be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected.
